Terms of Participation

Participation Policy

Participants in the Charity Mates are required to comply with this policy.

 

1. Terminology

Expressions defined in the Terms & Conditions below have the same meaning in this policy.

2. Participants’ Obligations

2.1 Participants are reminded that each Participant is participating in the Charity Mates programme on a charitable basis. When participating in Charity Mates, participants must be polite, respectful and courteous in their dealings with one another. This includes in all communication as well as being punctual when receiving or providing services.

2.2 It is Participants' responsibility to ensure that the services are carried out legally and safely.

2.3 Participants acknowledge and consent to their personal information being used, disclosed and otherwise handled in accordance with The Impact Suite’s Privacy Policy.

3. Specific obligations for Charities

3.1 When requesting a service to be listed on the The Impact Suite’s Charity Mates list, Charities must ensure that:

  • they have a genuine need for that support now and they are not profiting or intend to profit from the generosity of other charity’s volunteers. The intent of Charity Mates is to enable existing Charities to meet increased demands for services due to current crisis circumstances for services they already provide to their clients or the community;
  • they are asking for a service that is needed by the Charity or their intended recipient (e.g. the service will have a significant positive social impact on the recipients); and
  • they have the means to safely deliver the service if they indicate they can do so.

3.2 Charities who request a service must:

  • ensure a safe environment and/or workspace for the service provider;
  • be satisfied that the service provider is suitably qualified, and in all other respects, fit to provide the service; and
  • if required and necessary in the circumstances, obtain the recipient's consent to disclose any personal information of the recipient in order for the service to be provided to them.

3.3 Charities and individuals must not select a service to support unless they can meet the requirements, if any, that are stipulated or the required time-frame.

3.4 Charities authorise The Impact Suite to use their name and brands for the purpose of operating and promoting The Impact Suite and the Charity Mates Programme.

3.5 Charities must comply with The Impact Suite Privacy Policy when being the recipient of and using personal information provided to them by The Impact Suite under the Charity Mates Programme.


Terms & Conditions for Charity Mates

The Impact Suite Ltd ABN 13 619 188 162 is the founder and administrator of the Charity Mates Programme. These terms and conditions apply if you wish to participate in the Charity Mates Programme. If you do not accept these terms and conditions, then we ask you to refrain from participating in the Charity Mates Programme.

1. Definitions

A few definitions:

a. Charity Mates means any person or registered charity willing to donate their services;

b. Charities means charities registered with the Australian Charities and Not-for-profit Commission such as emergency relief centres, humanitarian support groups, community mental health agencies, and groups that provide services to underprivileged or people in need;

c. Charity Mates List means the list of services requested by Charities;

d. Charity Mates Portal means The Impact Suite’s Charity Mates List provided on our web site - www.theimpactsuite.com or by any other means including mobile device application;

e. Charity Mates Programme means the programme whereby Charity Mates donate services to Charities using the Charity Mates Portal;

f. Services mean the premises,vehicles, goods and services on the Charity Mates List; and

g. Participant means Charity Mates and Charities

 

2. Amendments to terms and conditions

The Impact Suite reserves the right to amend these Terms and Conditions from time to time. Amendments will be effective immediately upon notification on its website. Your continued participation in the Charity Mates Programme following such notification will represent acknowledgement by you to comply by these terms and conditions as amended.

3. How the Charity Mates Programme works

The Charity Mates Programme is designed to connect Charity Mates and Charities. There is no agency, partnership, joint venture or employment relationship intended or created by or arising out of the Charity Mates Programme. We do not represent or act for either Charity Mates or Charities nor do we endorse any Charity Mate or Charity. We merely act as a passive conduit for the publication of information about goods and services requested by charities. We do not assist with the services requested or provided. As a result, the delivery and supply of services is the responsibility of Participants. It is the responsibility of Participants to exercise caution and practice safe behaviour when participating in the Charity Mates Programme. It is the responsibility of Participants to hold appropriate insurance.

 4. Must be registered

To participate in the Charity Mates Programme, Charities must be registered with the Australian Charities and Not-for-profits Commission (ACNC). The Impact Suite reserves the right to refuse, suspend or end your participation in the Charity Mates programme at its sole discretion. We may notify other Participants that your participation has been refused, suspended or ended.

5. Participation

As a Participant in the Charity Mates Programme,you agree to comply with the following:

a. our Participation Policy. 

b. our Privacy Policy. Click here to read;

c. any applicable regulations and laws relevant to your participation including food standards, workplace health and safety, child safety and protection, environmental and any approvals or permissions as required;

d. if you are a Charity Mate, you must only supply goods and services that you own;

e. if you are a Charity Mate and you are providing a service you must ensure you or those persons carrying out the service are adequately qualified to do so;

f. you agree not to impersonate any other person while participating in the Charity Mates Programme;

g. you will not engage in any unsolicited advertising or provide promotional materials in the course of participating in the Charity Mates Programme;

h. you will only use the Charity Mates Portal for charitable purposes;

i. you will report any inappropriate behaviour by other Participants to us, including offensive, inconsiderate, intimidating or aggressive behaviour or services which have been misrepresented or are intentionally misleading;

j. if you are a Charity you will respond to any Charity Mate or The Impact Suite communication within a reasonable time. Charities acknowledge that if a Charity Mate has a bad experience while participating in the Charity Mates Programme that this may deter them from any future participation in the Charity Mates Programme;

k. if you are a Charity, unless the Charity Mate has otherwise given their express written consent, you will not use any of the personal information of a Charity Mate obtained while participating in the Charity Mates Programme for any other purpose other than to arrange for the collection or delivery of an Item. For the avoidance of doubt, this includes storing a Charity Mate's personal information in a database for the purposes of using it to solicit further support or donations from the Charity Mate;

l. you must not, at any time, hold yourself or organisation out as being an agent, a representative or an affiliate of The Impact Suite;

m. if you are a Charity Mate, you will not provide goods or services that:

  • you know to be unsafe;
  • are not in a reasonable condition;

- are not fit for the purpose that they are intended to be used; or

  • you do not own;

n. Charity Mates will not include or add any other goods or services which were not part of the originally requested goods or services by the Charity on the Charity Mates List without their express written consent;

o. if you are a Charity Mate, you acknowledge that if on inspection of goods or services provided, the Charity does not deem it suitable for its intended purpose, they are under no obligation to accept the goods or services;

p. your participation is not for an improper purpose nor is your participation in the Charity Mates Programme illegal or prohibited by laws which apply to you;

q. the Charity Mates Portal may not be available at all times or at any specific time(s);

r. we do not undertake to retain records of specific goods and services made;

s. if you download any material from the Charity Mates Portal, we are not liable to you for any loss or damage, however caused,arising from the downloading or subsequent use of the downloaded material. You may not adapt, reproduce, store, distribute, transmit, print, display, publish or create derivative works from any material on The Impact Suite website;

t. you may not use our logos or name or represent that you are affiliated with The Impact Suite without our express written consent; and

u. we may withdraw any services from the Charity Mates Portal at any time, at our sole discretion. We are under no obligation to notify Participants if we withdraw an Item or a request.

6. No liability, representations or warranties

a. You agree that we will be under no liability to you in respect of any loss or damage (including indirect, special or consequential loss or damage) which may be suffered or incurred by you or which may arise directly or indirectly in respect of goods or services provided using the Charity Mates Portal or in respect of a failure or omission on the part of another Participant to carry out and/or complete a service.

b. You release us from all actions, claims and demands that you may have against us arising out of a failure by us to comply with these Terms and Conditions or a failure by another Participant to comply with these Terms and Conditions.

c. You acknowledge that we make no representation as to the ownership of or title in goods or services or their suitability,quality or safety nor are we responsible for any representations made by Participants including their ability to complete a service through the Charity Mates Programme.

d. Our website may contain links to other websites.Those links are provided for convenience only and may not remain current or be maintained. You acknowledge that we are not responsible for the content or privacy practices associated with linked websites. Our links to other websites should not be construed as an endorsement, approval or recommendation by us of the owners or operators of those linked websites, or of any information,graphics, materials, products or services referred to or contained on those linked websites, unless and to the extent stipulated to the contrary.

7. Governing law

These terms and conditions are governed by the laws in force in Queensland.
